Terms & Conditions

1. Definitions
In these terms and conditions “D’vine Catering” means Totally D’vine Catering Ltd, “the Client” means the person, firm or company making the booking; and “the Booking” means the function to be catered for by D’vine Catering; and “the Quotation” means D’vine Catering quotation of price based on the estimated number of persons who will attend the Booking.

2. Variations
These terms and conditions may only be varied in writing and signed by an authorised representative of D’vine Catering.

3. Confirmation
The Client must confirm all bookings in writing by accepting the terms and conditions set here at the bottom of this form and by paying the required deposit. Only then does an enquiry become a confirmed booking with D’vine Catering.

4. Deposit
Either a 20% deposit of the total anticipated costs or £500, which ever is lower is required to confirm all bookings and secure the services of D’vine Catering. If the deposit is not paid on the date(s) specified, D’vine Catering reserve the right to cancel the booking. Deposits and prepayments are non-refundable.

5. Cancellation
Any cancellation of an event or catering by the client must be notified to D’vine Catering in writing. In the event of such cancellation the following percentages of the quoted price will be payable by the customer to the Company:
Cancellation with 84 days of the date booked for the event – 25%
Cancellation with 56 days of the date booked for the event – 50%.
Cancellation within 28 days of the date booked for the event – 100%.

6. Numbers, Dietaries & Table Plans
The company requires 100% of your guests are catered and paid for to ensure enough produce for the booked event. Final numbers, table plans & dietaries are required at least 28 days advance of the event.

7. Menus
D’vine Catering reserve the right to substitute alternative food and drink if the items ordered cannot be obtained D’vine Catering will, where applicable and possible, discuss any such changes in advance with the Client and prices may be subject to revision.

8. Payment
All payments must be cleared 28 days in advance of any event

9. Pricing
Due to economic changes outside of our control our costs will naturally fluctuate. To protect your booking and the business we have linked our quotes to the consumer price index ‘CPI’ meaning your final price could change. The CPI percentage will be tracked and where applicable added to your final invoice . The rates will be calculated from the time of your booking being confirmed to the due date for payment for your event. CPI rates can be found at https://www.ons.gov.uk/

Date booking confirmed: February 2022
Date booking due to pay: August 2022
Value £4500.00
Percentage change: 6.304%
Adjusted value: £4783.68
In addition to this, each January there will be a +3% increase to our standard tariff

10. Third Party Arrangements
The Client agrees to accept the terms and conditions imposed by any subcontractor or venue booked on the clients behalf by D’vine Catering.

11. VAT
VAT at the current rate will be payable on all charges unless an inclusive rate has specifically been quoted.

12. Complaint
Any complaint shall be made promptly and in any event must be received at the company’s office in writing addressed to the Manager, Giles Gottig not more than 48 hours from the date of the event concerned. We cannot accept complaints after this time.

13. Clients Obligations
The Client shall be responsible for arranging their own insurance to cover any potential loss due to theft, damage, cancellation or replacement of the event (however caused). The Client or their guests will not bring any food for consumption, on to or remove food or beverages from the venue at
any time. The Client is responsible for all property used on the day. The Client will recompense D’vine Catering for any damage to or theft of property
while it is in their care.

14. Force Majeure
If due to war, strikes, industrial action short of a strike, lockouts, accidents, fire, blockades, import or export embargo, ice, obstruction, natural catastrophes, government intervention, national or local disaster, terrorism or other such events beyond D’vine Catering control, D’vine Catering is unable to perform its obligations to the Client, D’vine Catering will be under no liability to the Client for any loss or damage which may be incurred by the Client.

15. COVID
Any bookings taken that cannot then be taken due to a government decreed lockdown will be able to request a mutually agreed date change within 24 months of the booking date.

16. Governing Law
The contract which incorporates these terms and conditions shall be governed under English law and the parties submit to the exclusive jurisdiction of the English courts.

17. Acceptance
By accepting these terms the client confirms that they have read and understood the above terms and conditions and agree to abide by the same. Written quotations are valid for 30 days from the date of quotation and may be subject to change following a site visit.
